Terms & Conditions

Terms and Conditions

Please take a moment to read these terms and conditions carefully.

Definitions

  • Company means Oludeniz Activities. Also referred to as OAC throughout this document.
  • Customer means any person, firm, company or other legal entity that makes a booking with OAC and includes anyone on whose behalf a booking is made.
  • Participant means any person taking part in a Tour or Activity provided by OAC.
  • Tour or Activity means any tour, activity, guiding day, instruction, event or service provided by OAC.
  • Contract means the agreement between OAC and the Customer for the provision of a Tour or Activity.
  • Terms and Conditions means these terms and conditions of booking and provision.

Booking Conditions

  • A contract between OAC and the Customer is formed when OAC confirms acceptance of the booking and receives the required deposit or full payment.
  • Participation in water and outdoor activities involves inherent risks that cannot be completely eliminated. OAC uses appropriately qualified and experienced staff and will at all times seek to manage these risks using established professional practice. By booking a Tour or Activity, the Customer and all Participants acknowledge and accept that accidents and injuries can still occur despite all reasonable precautions.
  • Any Participant under the age of 18 must be accompanied by a responsible adult aged 18 or over unless otherwise agreed in writing by OAC. That adult will remain responsible for the Participant’s conduct, supervision and compliance with all instructions and safety requirements for the duration of the Tour or Activity.
  • For organised groups (including schools, clubs and youth organisations), the group organiser confirms that appropriate parental consent has been obtained and that relevant medical information will be communicated to OAC or its instructors as necessary.
  • The Customer and all Participants are responsible for the safekeeping of any equipment issued for use during the Tour or Activity. OAC reserves the right to charge for equipment that is lost, damaged or misused other than through fair wear and tear.
  • All bookings are accepted on the basis that the Customer and all Participants will comply at all times with the safety instructions and operational guidance given by OAC and its staff.
  • By making a booking, the Customer confirms acceptance of these Terms and Conditions on behalf of all Participants included within that booking.

Fees and Deposits

  • Unless stated otherwise, all fees published by OAC are inclusive of KDV (Turkish VAT tax).
  • Where the date of the Tour or Activity is more than 6 calendar weeks away, a deposit of 25% of the total booking value is required to secure the booking. The deposit forms part payment of the total fee.
  • A booking is only confirmed once OAC has received a completed booking form and the relevant deposit or full payment.
  • The remaining balance is due no later than 1 week before the date of the Tour or Activity. If the balance is not paid by this date, OAC reserves the right to treat the booking as cancelled by the Customer and apply the cancellation terms set out below.
  • Deposits are non-refundable except where OAC cancels the booking and no alternative arrangement is agreed.

Vouchers

Vouchers purchased from OAC are valid for 12 months from the date of issue, after which they expire and hold no value. Vouchers are non-refundable and have no cash value except where purchased for a specified monetary amount, in which case they may be redeemed against the cost of a Tour or Activity provided by OAC.

Vouchers are non-transferable unless OAC agrees otherwise in writing. Once a voucher is redeemed against a booking, the Company’s standard booking, cancellation and rescheduling terms apply. If a booking made using a voucher is cancelled, no refund will be made in respect of the voucher, however where the applicable notice period is met the booking may be transferred in accordance with the relevant terms below.

Variations in Numbers

  • Requests to increase participant numbers must be agreed with OAC no later than 7 days before the date of the Tour or Activity and will be subject to staffing ratios, equipment availability and other operational considerations.
  • Requests to reduce participant numbers made more than 1 weeks before the date of the Tour or Activity will result in the total booking value being recalculated. Any amount paid above the revised booking value will be refunded. Deposits remain non-refundable and continue to form part of the booking.

Date Changes

  • Date changes requested by the Customer more than 7 days before the date of the Tour or Activity will normally be accepted at no charge, subject to the availability of OAC on the requested new date.
  • If OAC cannot deliver the Tour or Activity on the requested new date, the original booking will remain in place unless the Customer chooses to cancel, in which case the normal cancellation terms will apply.
  • Date changes requested less than 7 days before the date of the Tour or Activity will not normally be possible and will be treated as a cancellation by the Customer.
  • Where a booking has been rescheduled, any subsequent cancellation will be assessed by reference to the original Tour or Activity date.

Cancellation by the Customer

Cancellation charges are as follows:

  • Deposits are non-refundable.
  • Cancellations made more than 1 weeks before the date of the Tour or Activity will receive a refund of any balance paid above the deposit amount.
  • Cancellations made within 7 days before the date of the Tour or Activity will receive a refund less 50% of the total booking value.
  • No refund will be available for cancellations made less than 3 days before the date of the Tour or Activity.

Customers are strongly advised to obtain suitable insurance to cover cancellation, curtailment or other unforeseen circumstances.

Cancellation by OAC
Whilst every reasonable effort is made to ensure that Tour or Activities run as planned, Lake District Activities reserves the right to cancel a Course or Activity where this is necessary. Lake District Activities will notify the Customer as soon as reasonably possible if a Course or Activity cannot take place.
In the event that OAC cancels a Tour or Activity, the Customer will be offered either:

  • a full refund of all sums paid; or
  • an alternative booking on another date, subject to availability.

Adverse Weather and Conditions

Water and outdoor activities take place in dynamic environments where weather, ground conditions, wind and other factors may change. OAC instructors will assess conditions throughout the Tour or Activity and may modify the planned venue, route, timings or programme where necessary to ensure the safety of participants and the suitability of the activity.

Such adjustments are a normal and expected part of water activities and do not constitute cancellation of the booking.

If OAC determines that a Tour or Activity cannot be delivered safely or appropriately, the following options will be offered where reasonably possible:

  • an alternative activity on the same date and time;
  • a transfer to another suitable date at no additional cost; or
  • a credit note or full refund where no suitable alternative can be arranged.

Government Restrictions and Other Circumstances Outside Our Control

If OAC is unable to deliver a Tour or Activity due to Government restrictions, legal requirements or other circumstances outside the reasonable control of the Company, the Customer will normally be offered either:

  • the option to transfer the booking to a new date; or
  • a credit note for the full value of the booking.

If a Participant is unable to attend due to travel restrictions, border closures or other legal restrictions affecting that Participant, OAC may, at its discretion, offer a transfer or credit note. In all other circumstances the normal cancellation terms will apply.

Health and Fitness

Participants should expect to be involved in adventurous and sometimes physically demanding activities. Participants are responsible for ensuring that they are of sufficient health and fitness to take part in the Tour or Activity booked.

Participants are asked to provide relevant medical and personal information in advance of the Tour or Activity. Where this has not been provided, Participants must ensure that the instructor is informed of any relevant information before the Tour or Activity begins.

OAC reserves the right to refuse participation where, in the reasonable opinion of its staff, participation would present a risk to the individual concerned or to other participants.

Safety and Instructor Authority

Outdoor activities take place in natural environments where hazards must be actively managed. OAC will take all reasonable steps to deliver Tour and Activities safely and professionally.

The instructor responsible for the Tour or Activity has final authority over all operational and safety decisions including venue, route, equipment, group management and whether a Participant may continue to take part.

Unruly or Unsafe Behaviour

OAC reserves the right to exclude any Participant whose behaviour is considered by the instructor to be disruptive, unsafe, abusive or otherwise detrimental to the safety or enjoyment of the group. No refund will be given in such circumstances.

Personal Property

All personal property brought to a Tour or Activity remains entirely at the owner’s risk. OAC accepts no liability for loss or damage to personal property unless such loss or damage results directly from the negligence of OAC or its staff.

Complaints

If a Customer or Participant encounters a problem during a Tour or Activity it should be raised with the instructor as soon as possible so that it may be addressed at the time.

If the matter remains unresolved, complaints should be submitted in writing to:

Complaints will be acknowledged and responded to within 7 days.

Force Majeure

OAC shall not be liable for any delay or failure to perform its obligations where such delay or failure results from circumstances beyond its reasonable control including but not limited to acts of God, severe weather, natural disasters, war, civil unrest, industrial disputes, transport disruption, pandemics, or interruption of utilities or energy supplies.

Intellectual Property

Copyright and all intellectual property rights in OAC ’ website, branding, course materials and other published information remain the property of OAC unless otherwise stated.

Photographs

From time to time photographs taken during Tour or Activities may be used on the OAC website, social media channels or promotional materials. Participants who do not wish their image to be used should inform the instructor on the day.

Data Protection

Personal information provided during the booking process may be stored electronically or in paper form and will be used solely for the administration and delivery of Tour or Activities and for maintaining appropriate standards of service.

By providing this information the Customer consents to its use for these purposes. Contact details may occasionally be used to send updates or marketing communications. Customers may opt out of such communications at any time.

Applicable Law

These Terms and Conditions and any Contract between the Customer and OAC shall be governed by the laws of Turkey and any dispute shall be subject to the jurisdiction of the courts of Turkey.

The above does not affect the statutory rights of the Customer.
